WDW Limited, trading as Speedwinners, operates skill-based games that allocate prizes in accordance with the Terms and Conditions below.
1.1 By entering a Speedwinnners competition by any accepted means entrants are deemed to have the legal capacity to do so, are deemed to have read and accepted the Speedwinners Terms and Conditions and have agreed to be bound by them.
1.2 By accepting these terms and conditions you confirm that you do not contravene the laws of the country in which you reside. Speedwinners will not be in any way liable for any entrant entering any competition unlawfully.
1.3 The competitions are open to persons aged 16 and over and the age of majority in their country of residence. The promoters, their family, friends or any other party connected with the development or operation of Speedwinners are excluded from any competition. Any excluded competition entrants that are identified will have their entries nullified and payments refunded. Any competitions won by excluded entrants will be redrawn.
1.4 Speedwinners reserves the right to close a customer account at any time.
1.5 Competitions are governed by English Law, with any matters resolved under English Law and with the Courts of England having exclusive jurisdiction.
2.1 Speedwinners makes no representations or warranties as to the quality of any goods or services offered as prizes, and does not in any way guarantee the value, condition or roadworthiness of any prize at the time the prize is handed over to the winning entrant. No alternative prizes will be offered.
2.2 Winners must provide proof of identity and their competition receipt before the prize is handed over. For vehicles the V5 registration document must be completed before the prize is handed over. Speedwinners takes no responsibility for the prize once handed to the winning entrant. No tax or insurance is provided with any prize unless explicitly stated.
2.3. Cash alternatives are not offered unless explicitly stated on a competition.
3.1 Entrants via the website must follow onscreen instructions, correctly answer a skill or knowledge based question and agree to accepting the terms and conditions before completing their purchase. By entering the competition entrants acknowledge that entry does not guarantee in any way that they will win the prize.
3.2 Each entrant must create an account prior to completing their purchase, and must provide an email address and telephone number. It is the entrant’s sole responsibility to check their contact details have been entered correctly.
3.3 Maximum entry purchases by entrant are displayed on individual competitions. The maximum entry purchases by entrant varies by competition.
3.4 Speedwinners reserves the right to refuse or disqualify any entrant that it has reasonable grounds for believing has contravened any of these terms and conditions.
3.5 Each entrant agrees that the usual requirement under the Consumer Protection (Distance Selling) Regulations 2000 for any goods and services ordered online to be supplied within 30 days will not apply to Speedwinners prize competitions.
3.6 Each competition has a maximum number of entries stated for each competition. Once all entries are completed the competition will close, and a draw date announced with 48 hours. Prize(s) may be awarded by the promoter at any point with no minimum number of entries completed being required to do so. A competition may be closed and a winner drawn earlier than the stated competition closing date.
4.1 Speedwinners will determine and publish the period for which a competition is running. See individual competitions for individual time periods. Speedwinners reserves the right to extend the closing date of any competition.
4.2 Winners will be selected by an entirely random computer process that Speedwinners cannot influence in any way. There will be one winner per competition unless explicitly stated otherwise.
4.3 Once a winner has been drawn Speedwinners will make every effort to contact the winner using the contact details supplied by that entrant. Speedwinners is in no way liable for any failure or inability to make contact with any entrant due to inaccurate or incomplete entrant details supplied by the that entrant.
4.4 Each prize must be accepted as awarded and is non-transferable.
4.5 Prizes will be delivered free of charge to winners in mainland England, mainland Wales and mainland Scotland. Winners in non-mainland locations in England, Wales or Scotland will have their prize delivered to the nearest mainland port at an agreed date and time. Winners outside of these locations will have their prize delivered to the nearest English port for collection by the winner at an agreed date and time. If a winner does not collect a prize at the agreed date and time it will be returned to storage at Speedwinners’ location of choice and the winner will need to make arrangements to collect it at their own cost. All entrant expenses are the sole responsibility of the entrant.
4.6 Postal entrants must send an unenclosed post card with their full name, address, date of birth, contact phone number, email address, the competition that the entrant wishes to enter and the correct answer to the competition. Any illegible postcards will not be entered in any competition. Postal entrants will not receive confirmation of their entry. Postal entries are limited to one competition entrant per postcard. Multiple postcards in one envelope will not be counted. All postal entries must be received before the close of the competition. Postal entries will be processed at 12 noon Monday to Friday, and postal entries received after that point will be processed the following day. All postal entries are subject to the same terms and conditions as online entries. If Speedwinners believes that one person is making multiple entries with different aliases, then all entries will be null and void and the account will be closed.
5.1 All entries are final, and refunds will only be made in the event of a competition being cancelled by Speedwinners, or in the case of an excluded entry. Speedwinners reserves the right to cancel any competition. Where entry fees are returned Speedwinners shall have no further liability to the entrant or to any other person.
6.1 All entrants are automatically entered into the Speedwinners database for the purpose of communications regarding competitions entered and any future promotions or competitions offered. Contact details will be used to post the winner’s name and town of residence on the Speedwinners website.
6.2 The entrants and Speedwinners recognise that contact and other personal data as defined by the Data Protection Act 1998 and as supplied by the entrant may be used to administer the website and conduct competitions according to these terms and conditions. This data may also be disclosed by Speedwinners by choice or at the request of a third party for the prevention of fraud and money laundering or for other legal, financial or regulatory reasons.
6.3 Winners are required to provide or pose for photographs or video to be used by Speedwinners only for promotional purposes, and to identify them as a winner of a competition. An entrant may choose to obscure their face if they are very shy!
7.1 Any personal data that you supply to Speedwinners or authorise Speedwinners to obtain from a third party, for example a credit card company will be used by Speedwinners to administer the competitions and award prizes. Speedwinners may disclose data to (a) any credit card company whose name you give; (b) any person to whom Speedwinners proposes to transfer any of Speedwinners’ rights and/or responsibilities under any agreement Speedwinners may have with you; (c) any person to whom Speedwinners proposes to transfer its business or any part of it; (d) comply with any legal or regulatory requirement of Speedwinners in any country; and (e) to prevent, detect or prosecute fraud and other crime.
8.1 Except for liability for death or personal injury caused by the negligence of Speedwinners, Speedwinners shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by Speedwinners, its servants or agents in developing, planning and administrating competitions, distributing a prize to a winner or following the distribution of the prize. Speedwinners accepts no liability for errors or omissions contained within any part of the website. It is the responsibility of the entrant, and winner, to satisfy him or herself as to the accuracy of any information contained in this website.
8.2 Speedwinners will not be liable for any loss suffered by an entrant as a result of incomplete or inaccurate entries, a failure in communication by Speedwinners or any internet accessibility or any loss suffered as a result of the website. Speedwinners accept no responsibility for failed, partial or scrambled computer transmissions, hardware failure, software failure, server faults or any other reason.
8.3 Entry to a competition shall not be construed as creating any form of contract, joint venture or any other agreement between any entrant and Speedwinners.
